What is the EB-2 National Interest Waiver?

The EB-2 National Interest Waiver (NIW) is one of the most flexible US employment-based immigration pathways. It allows highly skilled professionals with advanced degrees or exceptional ability to self-petition for a US green card — without an employer sponsor, job offer, or PERM labor certification.

The NIW framework is based on the landmark 2016 Matter of Dhanasar decision by the USCIS Administrative Appeals Office, which established the modern three-prong test for eligibility.

The Three-Prong Dhanasar Test

Under the 2016 Matter of Dhanasar framework, USCIS uses three criteria to evaluate NIW petitions. You must satisfy all three.

Substantial Merit & National Importance

Your proposed work must have both substantial merit and national importance to the United States. The scope of the work must be national or global — not just local or regional.

Examples of qualifying work: medical research, STEM innovation, policy development, healthcare provision, educational leadership, sustainable technology.

Well-Positioned to Advance the Work

You must demonstrate that you are well-positioned to advance your proposed work, based on your education, skills, knowledge, and record of success in advancing the work.

Evidence: publications, citations, awards, patents, grants, leadership roles, expert recommendations, media coverage of your work.

Balance of Benefits to National Interest

On balance, it would benefit the United States to waive the job offer requirement. This considers the national importance of the work, your qualifications, and any other relevant factors.

Key factors: urgency of the work, uniqueness of your qualifications, benefit of waiving job market protection vs. national interest.

Base EB-2 Requirement (Step 0)

Before qualifying for the NIW, you must first meet the general EB-2 category requirements by satisfying one of these criteria:

Advanced Degree

Hold a US advanced degree (Master's, MD, JD, PhD), or a foreign equivalent. A Bachelor's degree plus 5 years of progressive work experience can qualify as equivalent to a Master's degree.

Exceptional Ability

Demonstrate exceptional ability in sciences, arts, or business — a degree of expertise significantly above that ordinarily encountered. Requires at least 3 of 6 specific types of evidence.
